Justice Ranjan Gogoi sworn in as CJI, succeeds Dipak Misra

Justice Gogoi will have a tenure of a little over 13 months and would retire on November 17, 2019   Justice  Ranjan Gogoi  was Wednesday sworn in as the 46th Chief Justice of India. He succeeds Justice Dipak Misra. President Ram Nath Kovind administered the oath to the 63-year-old Justice Gogoi at a brief ceremony in Rashtrapati Bhavan's Darbar Hall. A Bench of Chief Justice Dipak Misra, Justice A M Khanwilkar and Justice D Y Chandrachud decided to re-consider the top court's December 12, 2013, order The Supreme Court on Monday said it will re-examine its 2013 verdict upholding the Indian Penal Code's Section 377 criminalising gay sex as it observed that "a section of people or individuals who exercise their choice should never remain in a state of fear". A Bench of Chief Justice Dipak Misra, Justice A M Khanwilkar and Justice D Y Chandrachud decided to re-consider the top court's December 12, 2013, order saying that "individual autonomy and also individual orientation cannot be atrophied unless the restriction is regarded as reasonable to yield to the morality of the Constitution". Cornered Vijay Mallya offers Rs 1590 cr as intent to pay debt

Vijay Mallya, the Indian liquor baron battling creditors seeking to recover dues, offered to deposit Rs 1,590 crore ($240 million) with India's top court to establish his intent to settle with lenders who had rejected an earlier payment proposal. Lawyers representing the founder of the collapsed   Kingfisher Airlines   Ltd, who the government says left the country earlier this year, filed an affidavit in the Supreme Court on Thursday in response to a directive to declare all his assets. The debt owed by the failed carrier is at the centre of India's drive to crack down on defaulters and clean up the balance sheets of its banks weighed down by soured loans. Mallya also told the court that overseas assets are not considered while granting loans, and sought permission to file information of his assets in a sealed cover on June 26. Vijay Mallya has left the country: Attorney General informs Supreme Court

The  Supreme Court  on Wednesday issued notice to  Vijay Mallya   on  petition  of consortium of banks seeking disclosure of his  assets  and seizure of passport. This followed a statement by the government's top lawyer,  Attorney General  Mukul Rohatgi   who informed the court that Mallya left the country on March 2.  The apex court has given Mallya two weeks to respond to the notice. JNU row: SC refuses to hear Kanhaiya Kumar's bail

The  Supreme Court   today has refused to hear JNU Student Union president Kanhaiya Kumar's bail plea, saying he should first go to the high court and follow the legal process.  According to advocate Soli J Sorabjee, Kumar faced security concerns and they feared he could be attacked there. Aadhaar not mandatory for Direct Benefit Transfers, clarifies RBI

Use of Aadhaar cards and seeding of bank accounts with those numbers are purely voluntary and not mandatory,RBI said in a clarification on the Direct Benefit Transfer(DBT) Scheme. “… In view of the Supreme Court’s interim orders dated August 11, 2015 and October 15, 2015… On usage of Aadhaar, it is hereby clarified that use of Aadhaar card and seeding of bank accounts with Aadhaar numbers is purely voluntary and it is not mandatory,” RBI said in a communication to banks. No relief for auto makers as SC upholds diesel vehicle ban

The automobile manufacturers, who had moved the Supreme Court seeking modification of the court’s December order banning registration of diesel vehicles in the capital, did not get any immediate relief. Senior advocates Kapil Sibal, Abhishek Manu Singhvi and Aryama Sundaram contested the premise that diesel vehicles are polluting by nature and argued that it depended on the technology. Sibal and Singhvi appearing for the SUV manufacturers also argued that the larger vehicles account for just 0.2% pollution and that smaller vehicles contribute more to the pollution.   Read More

Lodha committee proposes sweeping reforms for BCCI

The Supreme Court-appointed Lodha Committee today recommended sweeping reforms for the controversy-ridden  BCCI , suggesting a bar on ministers from occupying positions, putting a cap on the age and tenure of the office-bearers and legalising betting. The committee has also proposed that BCCI be brought under the RTI Act so that it is made accountable to the government without hurting its autonomy. In a series of drastic reforms, the three-member panel, headed by Justice (Retd) R M Lodha, also suggested one unit should represent one state, while taking away the voting rights of institutional and city-based units. The committee also suggested the restructuring of the BCCI’s administrative set-up, proposing the position of a CEO accountable to a nine-member apex council. Supreme Court upholds Kerala's prohibition policy

The Supreme Court on Tuesday upheld the Kerala government’s liquor policy restricting service and consumption of liquor at bars in five star hotels only. An apex court bench comprising Justice Vikramjit Sen and Justice Shiva Kirti Singh in their judgement pronounced on Tuesday said that petitions challenging the  Kerala liquor policy  are dismissed and the Kerala High Court judgement sustaining the liquor policy is upheld. The liquor policy, upheld by the apex court, allows service of liquor at bars in five star hotels only. Under the policy, the sale and consumption of liquor at the bars in hotels below five star is prohibited. Kerala government, defending its policy, had said that those ousted from the business had no fundamental right to continue selling liquor at the bar. Maharashtra govt to challenge Salman Khan's hit-and-run case acquittal in SC

The Maharashtra government today told the Bombay High Court that it will file an appeal in the Supreme Courtagainst actor  Salman Khan ’s acquittal in the 2002 hit-and-run case.  The state government told the High Court that it will file a special leave petition in the apex court, The Hindureported.  The High Court had, on December 10, acquitted the actor of all charges in the case, in which one person sleeping on the pavement had been killed and four others injured.  “Prosecution has failed to prove any charges against Salman Khan,” the court had observed. It had also said that the prosecution had failed to prove that the actor had consumed alcohol and was driving his Toyota Land Cruiser when the mishap took place.

Diesel engine ban: SC order clears paths for registration of small cars

Diesel engine ban  :The Supreme Court order on Wednesday not only banned registration of diesel vehicles with engine capacity of over 2000cc until March 31, 2016, it also cleared the air on registration of smaller diesel vehicles. Recently, the National Green Tribunal ordered a ban on the registration of all diesel cars in Delhi. The green court had also asked the government to stop buying diesel cars in the national capital. The NGT was to review these provisional orders on January 6, 2016. But now that the Supreme Court order is out, NGT’s earlier directions have been overruled. The Bench of the apex court clarified it in as many words: “notwithstanding any order to the contrary passed by any court or authority or Tribunal whatsoever.” However, buyers of small diesel cars will have to pay higher pollution tax from next year.
